Welcome to TotTrackr! These Terms of Service ("Terms") govern your use of the TotTrackr mobile application ("App") provided by DahVio Studios ("we," "our," or "us").

By downloading, installing, or using TotTrackr, you agree to these Terms. If you don't agree, please don't use the App.

1. Use of the App

1.1 License

We grant you a personal, non-exclusive, non-transferable, revocable license to use TotTrackr for personal, non-commercial purposes.

1.2 Acceptable Use

You agree to use TotTrackr only for tracking your baby's care activities. You will not:

Use the App for any illegal or unauthorized purpose
Attempt to reverse engineer, decompile, or hack the App
Remove or modify any proprietary notices
Use the App to harm, harass, or violate the rights of others

1.3 Age Requirement

You must be at least 18 years old to use TotTrackr. The App is designed for parents and caregivers, not for use by children.

2. Medical Disclaimer

IMPORTANT: TotTrackr is a tracking tool, not medical advice.

TotTrackr is designed to help you track and organize your baby's care activities. It is NOT a substitute for professional medical advice, diagnosis, or treatment.

Always consult your pediatrician for medical advice
Do not rely solely on the App for medical decisions
In case of emergency, call 911 or your local emergency services
The feeding targets shown are general guidelines, not personalized recommendations

We are not healthcare providers and make no medical representations. You use the App at your own risk.

3. Premium Features

3.1 Purchase

TotTrackr offers optional Premium features available for a one-time purchase of $19.99 USD (or equivalent in your currency).

3.2 What You Get

Premium includes:

Multi-device sync with partner/caregivers
Unlimited history
Multiple baby profiles
Advanced export options
All future Premium features

3.3 Payment

Payment is processed through Apple App Store or Google Play Store. Their payment terms apply.

3.4 No Refunds

All purchases are final. We do not offer refunds except as required by law. If you have issues, contact us at support@tottrackr.com and we'll try to help.

3.5 Cancellation

Premium is a one-time purchase with no recurring charges. You can disable Premium sync features at any time from Settings, but the purchase is non-refundable.

4. Your Data

4.1 Ownership

You own all data you enter into TotTrackr. We claim no rights to your baby's information.

4.2 Storage

Free version: All data is stored locally on your device only.
Premium sync: Your data is encrypted and stored on secure Google Firebase servers.

4.3 Backup Responsibility

Important: You are responsible for backing up your data. We recommend regularly using the "Export Data" feature. We are not liable for any data loss.

5. Intellectual Property

TotTrackr, including its design, features, and content, is owned by DahVio Studios and protected by copyright and trademark laws. You may not copy, modify, or distribute any part of the App without permission.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

The App is provided "AS IS" without warranties of any kind
We are not liable for any damages arising from your use of the App
We are not liable for data loss, even if we've been advised of the possibility
Our total liability to you shall not exceed the amount you paid for Premium features (if any)

7. Changes to the App

We may:

Add, modify, or remove features at any time
Change Premium pricing for new purchases (existing purchases unaffected)
Discontinue the App with 30 days notice

8. Changes to These Terms

We may update these Terms from time to time. We'll notify you by:

Posting the updated Terms in the App
Updating the "Last Updated" date
Showing an in-app notification for significant changes

Continued use of the App after changes means you accept the new Terms.

9. Termination

You can stop using TotTrackr at any time by deleting the App. We may terminate or suspend your access if you violate these Terms.

10. Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law provisions.

11. Dispute Resolution

Any disputes will be resolved through binding arbitration in California, except where prohibited by law. You waive your right to participate in class action lawsuits.

12. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full effect.
